PROBLEMS OF ACHIEVING THE MINIMUM SHARE OF IMPORT SUBSTITUTION IN PUBLIC AND MUNICIPAL PROCUREMENT

Abstract

The article examines the practice of fulfilling the obligation of state and municipal customers to achieve the mandatory minimum share of domestic goods in the framework of meeting the requirements of extra-budgetary quotas. Attention is drawn to the ill-conceived mechanism for the implementation of the national regime in the case of procurement at the expense of other income-generating activities. The author has identified a group of problems associated with the possibility of applying prohibitive and restrictive measures in the implementation of purchases at the expense of extrabudgetary funds. The controversial position of state bodies in relation to the implementation by state and municipal customers of their right to establish requirements for providing information on the location of goods in specialized registers is reflected. The article analyzes the problems of using import substitution in the implementation of small-volume purchases. Attention is drawn to the impact of the lack of current control over the achievement by state and municipal customers of the mandatory minimum share of purchases of domestic goods, as well as administrative responsibility on the fulfillment of requirements for extra-budgetary quotas
