СРАВНИТЕЛЬНЫЙ АНАЛИЗ ЗАРУБЕЖНОЙ ПРАКТИКИ ОБОСНОВАНИЯ НАЧАЛЬНОЙ МАКСИМАЛЬНОЙ ЦЕНЫ КОНТРАКТА В СИСТЕМЕ РАЗМЕЩЕНИЯ ГОСУДАРСТВЕННОГО ЗАКАЗА
Аннотация
В работе выделены основные аспекты формирования и обоснования предельной цены при размещении государственного заказа участниками контрактной системы зарубежных стран. Анализ лучших практик проведения государственных закупок описан на примере таких стран, как США, Канада, Великобритания, Франция, Бразилия, Австралия. Выявлены отличия по сравнению с отечественной практикой обоснования начальной максимальной цены, связанные с обязательным проведением государственными заказчиками опроса участников закупочной процедуры, с пояснениями принятого решения комиссией государственного заказчика. В работе отражены зарубежные аналоги понятия начальной максимальной цены контракта, используемого в российской практике, которые подчиняются принципам согласования разумной и справедливой цены, а также открытому и скрытому характеру резервной цены. Раскрыта суть понятия предварительной цены государственного контракта, упомянутого в директивах и руководствах Европейского союза. Выявлены факторы, закрепленные в зарубежных нормативных актах, препятствующие формированию равновесной рыночной цены в системе размещения государственного заказа, связанные не только с конфликтом интересов, но и необоснованным предоставлением стоимостных и нестоимостных льгот
